Build-to-Rent HUD Loans

HUD update · October 2026

What HUD's Oct. 14, 2026 change means for build-to-rent communities of houses, duplexes and triplexes.

Can a build-to-rent community get a HUD loan?

Yes. Since October 14, 2026, HUD insures loans on build-to-rent communities: rental properties made up of detached single-family homes, duplexes or triplexes. HUD Mortgagee Letter 2026-12 says these properties are now treated under the same terms and conditions as traditional apartment developments, with a few extra requirements.

Two HUD programs apply. HUD 221(d)(4) can finance new construction of a build-to-rent community. HUD 223(f) can finance the purchase or refinance of one, but only if its certificate of occupancy is less than three years old when the application is filed. Before this change, HUD's multifamily loans were generally limited to buildings with four or more units.

Who is eligible

Eligible programs

HUD 221(d)(4) for new construction and 223(f) for acquisition or refinancing.

Newly built requirement for Section 223(f)

Acquisition or refinancing of BTR multifamily rental housing is eligible to recently constructed properties only. Properties with a certificate of occupancy dated less than three years before the HUD application submission are eligible under this revised guidance.

Property requirements

Communities must be located on a cohesive contiguous site, developed as long-term rentals, and operate as one multifamily rental property.

What HUD looks for

One connected site

Five or more homes built for long-term rental, on one site that reads as one community. No privately owned homes mixed in.

No lot sales

HUD won't approve selling homes or lots, or releasing any of them from the loan, during the loan term.

Professional management

Management and maintenance on site, or staffed locally, like comparable rental communities.

HOA can't get in the way

A homeowners' association must not limit HUD's rules or the owner's control of the property.

Accessible common areas

Houses, duplexes and triplexes are exempt from several Fair Housing design rules, but shared areas must be accessible.

Experience and modular

Builders and managers should have done similar projects. Modular and manufactured homes are allowed.

Based on build-to-rent comparables, not only apartment data
Replacement reserves
Expect higher deposits: more roofs, siding and windows
Mixed sites
Allowed alongside regular apartment buildings

Build-to-rent and HUD: common questions

When did HUD start insuring build-to-rent loans?
On October 14, 2026, effective immediately, under FHA Mortgagee Letter 2026-12, "Build-To-Rent Developments Underwriting Eligibility."
Can HUD refinance an older build-to-rent community?
Not under this change. HUD 223(f) is available for build-to-rent communities whose certificate of occupancy is less than three years old at application.
Can a build-to-rent loan include duplexes and townhome-style triplexes?
Yes. Detached single-family homes, duplexes and triplexes all qualify, and a site can mix them with regular apartment buildings.
